Certain restrictions can be imposed but there can never be a blanket ban for pets. Because pets do have their own rights and cannot be treated in an inhuman way. RWA has no authority to ban on keeping pets. Please give me Rank Five and follow me after reviewing my resume and book a consultation for further discussion and explanation if required.
Ban of pets is illegal: According to 'Section*Phone*Prevention of Cruelty to Animals Act,1960', it is illegal for housing societies to pass laws that disallow pets, not even on a majority vote by the residents of the society. ... Even complaints regarding a dog's barking habits cannot be used to ban the pet.
Pets cannot be legally disallowed from using lifts as per previous court rulings.If any resident is harassed by RWAs in animal matters, they should report them to the police immediately for illegal harassment or go to the Deputy Registrars of Cooperative Housing Societies or You can visit the animal welfare board in the local. Residents can approach the Registrar of Societies which has the right to cancel the registration of the association. As a last resort, residents can move the court of law as well. Apart from this one can file complaint against RWA to District consumer forum. A complaint can also be filed with the local police station having jurisdiction over your area. If the RWA forcibly hinders the entry of pets into the society premises that results in harm to the pet, a case under Section 428, 429 IPC (Indian Penal Code) can be registered against the RWA office bearers.
