Dear Sir, First get registered FIR in respect of Accused having received such amount. Thereafter, charge sheet will be filed. In many cases Courts are not inclined to convict the Accused as it is of civil nature. Better you file civil case also. Imprisonment is upto seven years and normally court will impose sentence of three years.
