Communication records (emails, texts) mentioning the borrowed money and repayment promises. 3. Consider Legal Consultation: Understand the legal nuances of your case, including the possibility of filing a case under Section 406 (criminal breach of trust) or 420 (cheating) of the Indian Penal Code (IPC) instead of 156(3) of CrPC (which is for recovery of dues). Draft a legal notice to the accused demanding repayment and potential legal action. Advise on how to approach the police if you feel the investigation is not progressing as expected. 4. You can File complain to Supritendent of Police or Commissioner of police to direct police to register FIR.
Dear Sir, If you are not having faith in the Police you may either wait till B report is filed that is no case report is filed then file objections to the same. Otherwise file application under Section 210 of Cr.P.C tp stay the Police investigation and you may be allowed to conduct your case as private complaint under Section 200 Cr.P.C.
