Dear Client, You can file an application before the magistrate requesting an early hearing of your petition. Your advocate should file an affidavit on your behalf, explicitly contradicting the IO's report and stating the true facts. Include any supporting documents that prove you have not received the alleged Rs 2 lakhs. You can also request the magistrate to issue a direction to the IO to clarify and correct the report. If the magistrate continues to delay without reason, you can approach the high court under Section 482 CrPC, seeking an order directing the magistrate to expedite the decision on your petition. You have to wait till the order of magistrate. Issue him notice through lawyer demanding your money and if he refused to pay then File Money RECOVERY SUIT IN COURT through lawyer.
