The situation you're in can be tricky. Here's what you can do: Gather Evidence (if available): Screenshots: If you have any screenshots of the original chat showing the receipt and payment of money, those would be your strongest evidence.Delivery Reports (Optional): While not as strong as screenshots, having "Delivered" or "Seen" notifications for the messages mentioning receipt and payment could be somewhat helpful. Consider the Amount: Small Amount: For a small amount, the cost and effort of pursuing legal action might not be worthwhile.Larger Amount: If the amount is significant, consider the following options: 1. Communication: Try to Reach Out: If you're comfortable, try contacting the person again calmly explaining that you have proof of the payment and requesting them to honor it. 2. Legal Action: Lawyer Consultation: Consult a lawyer specializing in civil disputes. They can assess your situation, advise on the best course of action, and determine if legal action is feasible.Lawsuit (Last Resort): Filing a lawsuit would be a last resort due to the time and cost involved. You'd need to present your evidence in court to convince the judge that the payment was made. Preventive Measures for the Future: Written Agreements: For future transactions, consider having written agreements (emails, receipts) to document payments, especially for larger amounts.Payment Apps: Using secure payment apps with transaction records can be helpful in such situations. Additional Tips: Maintain Records: Always keep copies of any communication or receipts related to financial transactions.Be Wary of Deleted Messages: Be aware that deleted WhatsApp messages are difficult to recover (almost impossible without technical expertise and cooperation from WhatsApp).
Hello. 1) If the entire chat is deleted as claimed by you, it will be a tougher task for the opposite person to claim any amount from you without any valid proof. 2) If he has the backup or proof with him and if the same is in his support, don't worry because the WhatsApp chats cannot be admitted and they cannot lead to conviction of any person in absence of supportive evidence. If you have further queries or questionnaire, you can get back to me. All the best
Let him file Money RECOVERY SUIT IN COURT through lawyer.
If recovery amount is big then you can file recovery suit and also pray for FSL Report. Thanks.
Dear Sir, You have to establish your case on the basis of messages sent from your mobile. Further, you have to establish your case by circumstantial evidence by way of documentary and oral evidence. It seems to be a civil case and it takes two to three years to get judgment. Take a wise decision as to whether to litigate or not.
Pray for Recovery of data and FSL from Court.... u can consult me for more.....
