Still u have an option to lodge an FIR under criminal conspiracy and cheating against the accused and his family members.
U can file a civil suit. Later on if the defendant does not appear in the court. Pass an exparte order. Go for attachment of his or his father's property through the process of execution.
file a complaint case or lodge FIR against the person u/s 138 NI Act and 420 IPC.
You can do any1 or all of these: 1. Send a statutory notice under section 138 NIA immediately. 2. Register a FIR in the local police station alleging fraud and conspiracy. 3. if he had property... file money recovery suit before civil court.... and if he not attend the court... he will become exparte ... and ask attenchment of property which is belonging to him... before judgement..
