Parallely you can file a civil suit for recovery of the money. Both civil and criminal case maintainable.
Send a legal notice u/s 138 NI Act asking him to make payment within 15 days from date of receiving the legal notice. If he doesn't file a cheque bounce case before JM within 30 days after the expiry of 15 days of the notice period. Care should be taken while drafting the legal notice.
Dear Sir, Get issue a legal notice within 15 days of date of bounce and then file cheque bounce case u/s 138 of NI Act in magistrate court.
This is my response to you: 1. Send a legal notice u/s 138 of NI act; 2. If he still does not then file a complaint in magistrate court; 3. If he still does not then the police can issue a warrant against him.
