    Mr.Rajendra, whether you have lodged any complaint about missing cheque with police authorities and informed your banker or not? How do you know that Mr..X has taken loan against the cheque? Whose signature were forged on the cheque? And is it a complaint under section 138 NI Act ? Pls provide details for correct advice.

    There is no CRIMINAL liability upon you if cheque was forged by someone else. You can file a criminal complaint against the person who signed with fake signature. Civil case for recovery of money will be defended having gone through the plaint. Thanks and Regards.
