We are two siblings. I am 18 and my sister is 19. To a recent visit to Delhi we met a boy near our house whose both the parents died when he was just a baby. His maternal grandmother and uncle and aunt are his present guardians. His guardians have planned to give him to anybody who would like to adopt him.That boy got so attached to us that he wants to come with us. So my parents decided to adopt him.His guardians are so fed up of him that now they say if someone is ready to take that without any sort of legal process they are ready to give him but the boy wants to come with us. They are ready to give him to us but being from a non educated background they think they just have to sign some papers and then we can take the boy. After consulting a lawyer nearby we got time know that such processes take 10 to 15 days.Now the issue is we are from Lucknow and all our visits to Delhi are just for a few days and even if we stay a bit longer my dad's job doesn't permit him for much leaves. Even if my dad takes leave the lack of interest in long legal process by that boy's family is making us to think twice but they want to give him to us. What exactly should we do in such a situation?

Dear Shristhti, court procedures takes time for sure bt its not always mandatory to attend the court for the whole time period as in since filing till the order there is no need to visit the court daily. talk to ur lawyer abt ur issues regarding time and make out a solution abt the same. Dear ma'am, Firstly I would like to know the age of the child whom your family is planning is adopt. Under the Hindu Adoption Act, you can only adopt a child who is below the age of 15 years. Secondly, yes it takes times. I will tell you the procedure : I) You have to make an application to Child Welfare Agency. ii) They talk to the parents and child who has to be given in adoption iii) Then a petition is to be filed in the court and after the court is satisfied, it issues the decree and adoption is finalized.
