Dear client, Rule 6 confers a discretionary power on the court to pass a decree based on the admission made by the parties without determining any questions raised by the parties. However, the remedy under this Rule cannot be claimed as a matter of right as this provision is enabling and discretionary in nature.
Order 37 CPC will also apply if suit is to be filed on the basis of Cheques ! And for your question under order 12 rule 6 CPC which refer judgement on admission of fact will also applicable on admission in the pleading or otherwise. Regards
Order 12 Rule is only to be used when Defendant Clearly Unequivocally , unambiguous and unconditional admission of the claim .
