Hello My brother expired 3 years back and left niece behind. Niece mother did second marriage and is in different city now at India. Child (niece) is with grandparents (India). I am only child of parents now with niece and parents at India whereas I am overseas with my family (spouse and 1 child). I would like to take adoption for niece presently with grandparents at India so i can move niece to overseas with me. however, mother of niece (who already had second marriage and is in different city) is not giving adoption for child (niece) staying with grandparents. this restricts me from doing adoption for niece in India and i am unable to move her outside India. For same reason, my parents; grandparents of niece are not able to come to be overseas as well and family is split at 2 countries. What legal option do i have to have adoption of niece as her mother has settled down with second marriage and my niece and grand parents are stuck India alone. please advise. Thanks Amrit

you can move to court for declaration of legal heir of your niece by making your parents and her mother as party .
