    - If the property is not stayed by the court, then one can proceed to gift the same . - However, even a court proceeding can be stopped , after settlement in the matter .

    Your question is still vague and indefinite as it has not been mentioned as to what order was passed by the court. The Decree passed by the court cannot be violated as it may put one in trouble However it can be got moulded with the active involvement of all the perties to the Suit.
