I have purchased a flat and have executed the sale deed with the builder. All together there is 50 plus flat. All have executed the sale deed with the builder. Now we have formed a housing maintenance society. The society has not executed the conveyance deed. Now our committee said they are issuing share certificates. Can they issue a share certificate without executing the conveyance deed with a builder? What is the difference between housing society and maintenance society?

You may file an appropriate complaint with the Govt.as per Model Bye Laws. Better to approach a local lawyer for filing a complaint.

Execution of Conveyance Deed is essential as the matter pertains to the owneship. Share Certificates Under what circumstances are proposed to be issued is yet to be cleared. The committee can issue share certificates if they wish to, but they will not be valid until the title and other necessary documents have been transferred from the builder. The difference is in name only, both housing and maintenance societies are formed to protect the homeowners’ and the property’s interests.
