Here are a few options for you- 1. File a case for the cancellation of the sale deed: You can file a case for the cancellation of the sale deed executed by the relative who sold his part of the house. You can claim that the sale was fraudulent and your relative had no right to sell the property without the consent of all the co-owners. The court may order the cancellation of the sale deed if it finds that the sale was illegal or fraudulent. 2. File a partition suit: You can file a partition suit to divide the property among the co-owners. You can claim his share in the property and ask the court to divide the property either physically or by way of compensation. The court may order the sale of the property and distribute the proceeds among the co-owners. 3. File a suit for injunction: You can also file a suit for injunction to prevent the promoter's agent from occupying the property. You can claim that the promoter's agent has no right to occupy the property and that his presence is causing damage to your property rights. The court may issue an injunction to prevent the promoter's agent from occupying the property. 4. File a complaint with the police: You can also file a complaint with the police against the promoter's agent for fraud and trespassing. You can provide evidence to the police to show that the promoter's agent has no right to occupy the property and that his presence is causing damage your property rights. Dear client I am sorry to hear that but in this case you can ask the person to leave your house and also you can serve him a notice regarding the same more over you can also move to the court seeking permanent injunction on the basis of trespass.
If that man is illegally trying to enter into your premises then it's a criminal offence and you can always get a FIR registered against him for "house trespass". And if he's saying that he was the tenant since 2015 then ask him to furnish the proof like the rent agreement dated back in 2015. You can also approach the court for permanently injuncting him to enter your premises. For more legal assistance I am just a call away.
