    Look the sale deed is a very important document which will reveal if the contention that has been raised by you is correct or not. Based on the sale deed mutation would ordinarily take place. But since you have already filed a suit in the case I would like to know if the suit is also for declaration or not. In case it is for declaration than mutation can happen after the suit is disposed of. In the alternative if the suit for declaration is not filed then the mutation can still be made according to the sale deed and if the khatian is not allotted to you then you can pray for a declaratory suit after serving a notice on the original vendor to rectify the mistake or even file a criminal case against him/her.     Hi, Please keep in mind that a mutation is null and unlawful without a registered sale deed. Errors may be corrected in a sale deed, by signing a supplementary document known as a rectification deed. A rectification deed is a document used to correct errors between parties but there must have been a genuine mistake, and the original deed should not accurately represent the parties' true intentions. If the seller made it willingly then you can file a lawsuit against the seller for fraud, and you can also seek compensation from the seller. You would have to either purchase the land from the other seller or resolve the issues if the land is sold twice, before mutation. If you find this answer helpful, please rate my answer. Thank You.
