I Live in a rented flat in a Building at 1st floor.The flat has a balcony where I regularly do Exercise.Some person from 2nd floor is continuously throwing garbage in my balcony to do mischief & irritate me.I have kept Patience for a long time but Now I want to take legal action against it.How can I find out that which person from 2nd floor is doing it & since after my little bit of research I found out that according of Section 268 of IPC ,private nuisance comes in Tort so in which court can I file Complaint?

Dear sir, First and foremost lodge a complain in the nearby police station. On the basis of your complaint police will do the investigation and will submit it's report.
