if the property is encestral you can claim through court if it's owner by parents you cannot claim... if in case it is not divided with any kind of documents like will gift.. in between the parents died at that time you have share in this property..

if the property is ancestral then you have equal rights as your brother but if the property is self acquired then you cannot claim equal share
