    - Since your mother in law , expired then her legal heirs can continue the said case filed by her. - Further, after becoming a party in the suit , the legal heirs can approach the High court for passing a direction to the court to finalize the matter in fixed time frame.

    Hi, The court only hears civil cases in which a defendant's right to sue survives his or her death. If there were other defendants and the cause of action still exists, the right to sue survives. However, if the suit's cause of action was personal in nature, the right to sue would be lost, and the lawsuit will be dismissed. In addition, if there are no other defendants in the case except your mother-in-law, her legal heirs willing to pursue the case can file an application under CPC Rule XXII Rule 4 within 90 days to get the legal representatives of the deceased defendant on record. Following the filing of the aforementioned civil suit, those legal members would be deemed, defendants. If you do not wish to pursue the case further, you may either dismiss it or reach an amicable settlement.
