  • You are required to apply for Letter of Succession in respect of all properties of parents if parents have not left any WILL or testament. Thereafter to get property mutated in your name. If there are other legal heirs then they are entitled to share in property.

    Hello Sir If you parents have left a will then you would be getting the property according to that will and you'll have to get that will registered. In case no will is their, then you'll have to get a successor certificate from the court and then transfer the property in your name on the basis of that legal heir certificate.     If there is no will made by your parents then all the properties owned by them will be equally divided amongst all their heirs (your brothers/sisters). For the same you will need a certificate of hierarchy first and then with other requisite details you can get the properties mutated in your name.     As per law, after the death of your parents , his property will devolved upon all the legal heirs equally. Hence if you are only legal heir of your deceased parent then you can apply for mutation in your name after submitting death certificate of your parents with your residential proofs.     collect legal heir certificate from the tehshilder which will certify that you are the sole legal heir of your parents property, After collecting the said legal heir certificate, transfer the property in your name my mutating the same in your favour duly submitting the death certificates of your parents, your voter ID card, legal heir certificate.
