I am a secretary to the Flat owners Association. Our flats are built in blocks of 2 flats in 1 block and 4 flats in 1 block with total flats of 110 in 45 blocks. One of the flat owners has purchased complete 1 block with 3 flats and had few disputes with the builder and forcefully encroached upon 1 bore well belongs to the association. Not paying maintenance from 2 flats from Apr 2015 and 1 flat he has not paid from Apr 2015 to Oct 19 and paying from Nov 19. Association has not stopped any service including water supply and Sewage disposal. However, it has stopped Block sweeping, passage mopping and wild growth removal around block since May 19 as a token of protest from Association Association had 2 discussions with him and recorded discussion. Association has not given its acceptance for construction of Septic tank. But he started digging and constructing septic tank For going to legal proceedings to court whether police complaint and subsequent CSR is required. Anything to be done .

you should have to move to court as soon as possible and also make a complaint to police

You have to take immediate action. You know very well that legal recourse is available with you. But you have to consult a lawyer in his office with all documents.

Mr. Rajendran , you have not sttatedxWhst type of Association formed by your flat .Registered under Societies Act or Apartment Ownership Act . If Registered under Ownership Act your Association should approach Civil Court for settling Dispute.If by Registrar of Society then approach Registrar for your relief.
