immediately you can file a complaint under Section 420- Cheating, Section 463- Forgery with police. Further immediately approach the court for staying the order of attachment. so the person have to prove the money transfer.
Immediately Approach the court and obtain an Injunction to stay the attachment proceedings. It will put you in embarrassing position and get an FIR Registered against the culprits. pls don't mind! it may be possible to forged anybody's signature but getting a Court order without any knowledge/information to the concerned party seems unbelievable, the Court must have sent summons to your address, anyway, 1. now in the present circumstances, you are advised to go through the complete case file thoroughly with the help of an experienced lawyer and start your legal action, 2. there must be an exparte order against your mother, therefore, challenge the said order and try to obtain stay on execution proceedings, 2. moreover, you can also file a criminal complaint against the said UNKNOWN person after getting his details from the case file
Hi, A promissory note is a binding agreement that someone will pay you a sum of money therefore if under any circumstances the note has been altered or not made under free consent such contract becomes null and void. Since the document is forged you can file a complaint under Section 420- Cheating, Section 463- Forgery. Also, since you are suffering harm to your reputation because of these forged documents you can also add the offense of defamation in your complaint as specified under Section 499. you may approach the concerned court or it's appellate court for staying the order of attachment.
