Dear Sir, If a party not before the Court you cannot say he has committed contempt of any Court order. Please contact your Advocate and find out possibility of impleading such party in the pending case and then issue contempt notice.
Dear Client, When a person fails to comply with a court order or an undertaking provided to the court, they may be dealt with for contempt. Non-compliance with court orders endangers the rule of law and undermines public trust in our legal system, which demands respect for the court’s authority. The Karnataka High Court observed that Order XXXIX Rule 2A of Code of Civil Procedure can be invoked against any party guilty of disobedience or breach of injunction even against a stranger to the suit. If a third party is not complying with a civil court order, you can file a contempt of court application under the Contempt of Courts Act, 1971, and summon the third party to appear in court.
