Asked in Company or corporations
Send a legal notice and after that proceed to file a case before the Labour commissioner /Labour court .
Dear client, While I understand your frustration about not receiving a layoff letter with reason from your company, sending a legal notice under Section 76 of the Indian Evidence Act, 1872 may not be the most appropriate or effective course of action in this situation. Here's why: Section 76 of the Indian Evidence Act: This section deals with proving the authenticity of certified copies of public documents. It doesn't apply to employment matters or obtaining a termination letter from a private company. Termination process and legal requirements: Depending on your employment contract and the Indian labor laws applicable to your situation, your employer may not be legally obligated to provide you with a termination letter stating the reason for your layoff. In some cases, simply providing notice or payment in lieu of notice may be sufficient. Alternative options: Before sending a legal notice, consider exploring other options like: Talking to your HR department: Try to understand the reason for your layoff and negotiate for a termination letter if possible.Seeking legal advice: Consult with an employment lawyer who can advise you on your rights and legal options based on your specific situation.Filing a complaint with the labor department: If you believe your termination was wrongful or unjust, you may be able to file a complaint with the relevant labor authorities. Sending a legal notice without proper understanding of your rights and available options could lead to unnecessary expense and complications.
Issue them notice through lawyer and File Complain in labour court.
