Your question is confusing, you said it was divided and partitioned in papers then you say it joint and un-partitioned. If it on papers then the yours is a case of partitioned land and every co sharer is in its separate and independent possession. In that case yours is a good case and is in your favour. But you are to prove that partition of land firmly and properly. otherwise, it will be debatable. first you have to make partition on paper and then you will get to know that which portion come in your side.how can you all mutually divide land and make construction on it.
Sir, you do first that make partition in your undivided properties among your brothers. I am sincere advising you that take your property by making partition deed or otherwise initiate civil suit against your parents and brother. If you construct the building without any valid papers then you will face difficulty in future.
