Contempt - Exparte hearing is a too stupid question to rethink.. What made u post this question.. Have u watched any such proceedings.. ? Did u suffer any case and seeking relief?.. or You want to teach lesson for us..
You r not even a lawyer, then how this question comes to ur mind.. and who told contempt .. exparte..
So u mean.. that u posted this question to teach lessons for senior lawyers.. isn't it? R u a lawyer ?
Criminal contempt is like physically disturbing the court proceeding.. Civil contempt is disobeying the order of the court.. as stated in CC Act.. For either case, its a penal action.. only penalty can be given.. then how exparte.. then only circumstances besides not penalty, is an attachment which arises when disobedience of interim injunction of a civil court.. But for that u need to file petition under o39 r2A of CPC, "Contempt of court is irrelevant.".. â˜ï¸ This is the professional opinion.. I think u r a junior advocate, atleast learn now.. and
if so, for what __ purpose, u have posted this question here?..
So u mean to say that.. You are damn sure that Contempt petition may be heard exparte.. No matter top lawyers says what..?..
Please send me.. Let me improve my knowledge.. I'll be glad if I find I'm wrong.. . . but exparte in 'contempt' is too strange..
How is that possible.. do u got any citations? There should be some logic..
