you can apply for legal her certificate in Tahshildar office. If they refuse to give then consult some advocate from your district court and apply for a succession certificate. And there is a third way: if you are in Uttar Pradesh (I don't know about other states) you have another option to file an application for succession certificate in the office of "Administrative General of UP in Allahabad High Court.
as per the provision of sec 8 of Hindu succession act " A Hindu died instat his property will go to his legal hair son, daughter, & wife, and is there is no first chass hair will go to !! class hair
no need of deceased affidavit... only documents mentioned in my earlier reply is required
file petition alongwith copy of death certificate of deceased, consent affidavits of the deceased legal heirs and copies of property for which you require heirship certificate
u can apply and get legal heirship certificate from Tahsildhar. If not they are giving for some reasons u can apply for a succession certificate in District Court.
