Hi, You can file a writ petition in the High Court under Article 226 of the Constitution. The Court will then demand the authorities to cover up the drain, and take necessary steps to make it safe. You can also file a claim foe damages due to loss of life due to negligence of the authorities.
You may file a petition in the Hon’ble High Court through High Court Legal Services Committee for free of cost. This is your right to get remedies through Court and free of cost.
You can approach the Consumer Court for damages for the loss of a precious life which took place due to the negligent act of the GHMC and its offices had they taken care to cover the open drains a precious life would have saved. You have to append all the supporting documents such as post mortem, representations made to the GHMC and other documents proving your case. You have a good case and you will succeed.
