As I already told You, they cannot stop you from smoking in your room. It is infringement of your fundamental rights under Article 21 of the Constitution which reads: “No person shall be deprived of his life or personal liberty except according to procedure established by law.â€
Is there any clause in the rent agreement with your landlord with respect to smoking ? Whether the family staying above are tenants or your landlord ? However you cannot be restrained by them to smoke in your flat because they cannot encroach upon your personal right and liberty.
