you can challenge the order issued by the management committee in relation to the maintenance cost
Dear Sir, You have to approach High Court with others who are facing similar problems.
If bigger flats are more than they do this only. But maintenance is charges as per sq ft basis like property tax, stamp duty etc. They not asked to pay same stamp duty, property tax etc because they cant do anything there. Sending legal notice should solve your problem before moving court.
Hi, As per law, maintenance charges are proportionate to the flat size. The committee cannot charge a fixed rate. You can approach the dy. registrar of the societies and complain against the committee. If you like my answer, please rate me.
You should file a civil suit. if you are in Chennai then the apartment house owners act will apply. You should file civil suit before the concerned court to fix fair maintenance amount.
you can sue them in court of law . As per Law the Maintenance is always chargeable as per Square feet basis . you can file case in Consumer Forum.
