If public authority claimed that one applicant filed a false affidavit before authority and rejected the applicant's claim. Is it obligatory on authority to prove that affidavit filed is false with some unimpeachable documentary evidence to file a criminal case against an applicant before a magistrate of first class? If not magistrate can reject the case. if the case admitted without any strong proof can punishment under IPC 193 attracts.

This provision is very commonly used as a tool for various reasons thus are generally rejected by Courts in majority of cases. Such cases succeeds in a rarest of rare cases.
