One of our clients asked us to book the shipment through MAERSK LINE for which we did the booking and they picked up the containers but due to some reason they did not do the shipment and the said containers were on hold at client place from June till October for which the detention incurred is moe than 75 lacs and client denied to pay the same. to save our name and fame we paid the same to agent / line even we asked the client to repay the same but they are denying the same. Can we lodge a strong case as this is an International law of Shipping and logistics about container detention at any end?

Since you mentioned the shipment remained on hold at Client's place but at whose instance is the only deciding point. Who put the containers on hold for Which you have now paid. Hi, Yes, you have strong grounds to file a case. You can also file a complaint against the client for cheating and fraud under Sections 415 and 420 IPC. You can reclaim your losses by filing a civil money recovery suit against them. If you found this helpful, please rate us.
