    It can be dealt in both ways. If it is alleged as fraud it is a Criminal offence and if it is named out as misappropriation it can be treated as Civil wrong. But Since the accounts were regularly audited and kept in the regular course of business it will be difficult to prove. Moreover, You got prepared Profit and Loss account and Balance Sheet as well while retiring from the Partnership the allegation will have no adverse effect on you.     Hi, Fraud is a criminal offence. You can provide proof that you did nothing wrong in your reply to his complaint. If the case filed by your ex-partner is false, you can file a counter complaint under S.209 IPC for false claims.
