Hello Sir You can apply for passport despite having a criminal case pending against you. As per the circular dated*Phone*issued by CPV Division of Ministry of External Affairs (MEA) you will have to give an undertaking while applying for the Passport. The undertaking given by you will contain information regarding the pending criminal case against you such as case number, court in which the case is pending, details of the investigating agency, date of last hearing, date of next hearing and an undertaking that you shall be present before the court/the authorities when required or requested. Furthermore, you have to get an order/leave from the court where the case is pending against you granting a No Objection Certificate for applying for passport as per GSR 570(E) dated*Phone*.
