I head the department. An employee of mine, slightly mental case, but unwilling to seek a psychiatrist's advice, keeps shirking work when asked to perform legitimate duties. We are afraid if we take any action, he may commit suicide and leave a note blaming us for it. How can we pre-empt any action by police in such an eventuality? Every day we hear police booking others under 'abetment to suicide' even when it is a known fact that there is always an element of psychiatric illness in all suicidal thoughts/actions. Please advise about 'anticipatory bail' like action to be taken by us so that police do not harass us just in case the employee attempts anything like self-harm and blame us for it.

Dear sir if it is confirm that this is case of mental illness then you can file case under mental health Act before magistrate for sending him for treatment moreover you file application before your superior officer about his mentally unfit, then they would take appropriate actions against him you can call me for advise

Attempting to suicide is itself. Secondly threatening to committing suicide is also a criminal act. Get file FIRs with police saying he he blackmailing you. Let it be on record. Please give me Rank 5 and Review my Resume and Follow me if my answer satisfies you

first of all inform the higher authority about the same and also make a complaint to police about the same court passed blanket order in a few cases
