    Your lawyer can ask him his decision or you can go ahead to file Contested Divorce. Contested Divorce can b converted to mutual at later stage.

    Hi, It is advisable that your lawyer contacts him and ask him for mutual consent divorce. You can move alone for mutual consent divorce and if you move to court for divorce then also he will excuse his absence due to lockdown so it is better to wait till lockdown and then proceed with divorce. You can also refer your case to mediation, if there will be any possibility for you guys to not proceed will divorce and resolve the issue then mediator will suggest you both the same.     if he is not in station you cannot file mutual consent.The petition for mutual consent should be signed by both the parties.

    You have already served him with a Notice. kindly ask your Advocate to contact him to know for once about his decision. if he is willing for mutual consent then please wait and file it together. if not you can file it under mental cruelty u/s*Phone*ia of the Hindu Marriage Act if you are Hindus.

    I would recommend that you file a pre litigation meditation in the court. Notices would be issued your husband and he would have to show up, either in person or virtually depending on the infrastructure available in court. once face to face you'll be able to iron out any issues and file for mutual divorce. pre litigation meditation is not only pocket friendly but also usually time effective.
