Dear A, Wife has residential rights over the husband's property as held by Hon’ble Supreme Court of India. She can not be get evicted from her sharehousehold as decided by Hon’ble Supreme Court. I have got few orders in this line.
The properties being self acquired, the wife cannot claim her right. How ever she can live their till the pendency of legal proceedings but not forever. Please give me Rank Five and follow me after reviewing my resume and book a consultation for further discussion and explanation if required.
Hi, The wife cannot claim residential rights over the property if it is not in her name. She can claim alimony. Yes the husband can sell or transfer the property but the question about it being advisable depends upon the reason for transfer. Please do rate us if you find this helpful.
during divorce prooceedings, at the time of granting maintainence , the assets of the husband are taken into consideration, these two properties are his assets, yes one can sell the properties . also she has no right over these two properties since it was self acquired by the husband. if the wife refuses to vacate the house, the husband can file an eviction suit
