Dear choice to your husband, mutual consent means both are ready to divorces.
Yes, You can demand any amount from your husband as a permanent alimony. It may be lacs or crores. Rather you are doing private job then also your husband is liable to pay alimony to you.
As the name suggests under mutual divorce the things are done mutually. It will depend upon the settlement agreement if any which both of you must have gone through. You can always demand a lump sum alimony from your husband as a full time settlement amount. As far as the maintenance to the wife is concerned it is given regardless of the earning capacity of the wife that is even the earning wife can claim maintenance from her husband. You can also demand the maintenance even after you are divorced till you remarry again. For more legal assistance I am just a call away.
Dear client, You and your husband can fix the maintenance or alimony through mutual consent if you are seeking divorce through mutual consent. According to the agreement, a particular amount of money can be given either by the husband to wife or vice versa as the case may be. Regarding your second query, initially, a misconception existed that a working woman is not entitled to claim maintenance as she is earning and is thus able to maintain herself. Now, based on the judgements in cases like Bhagwan v. Kamla Devi and Chaturbhuj v Sita Bai, it is evident that she can claim maintenance even though she is earning. Hence, you may claim maintenance. Thank you
