Hi, Cruelty has been introduced as a basis for divorce under the HMA. Whenever any person "as to induce a reasonable concern in the mind of the petitioner that living with the other party will be detrimental or damaging to the petitioner" have been included. Also, you can take the help of the DV act for substantiating your claim. The procedure to be followed will also depend on your religion. Therefore, visit a lawyer and he or she will let you know about the legal documents that needs to be curated to ensure that you are given proper redressal. For immediate redressal, you can even contact the nearest women commission. Thank you.

Hi, Immediately file a police complaint against your husband under the Domestic Violence Act and also file a divorce case on grounds of cruelty. For the custody of your children if his cruel behavior is proved the court will grant you custody taking into account the welfare of the children. If you find this answer helpful please rate my answer. Thank You.
