Hi, You may file a case for divorce under section*Phone*of the Hindu Marriage Act, 1955. However, the amount of alimony will depend upon the discretion of the court. If you find this answer helpful, please rate us.
According to a Supreme Court ruling, even if an estranged wife is earning, she can make a claim for maintenance if her income is not sufficient to sustain her. So, the belief that a working woman cannot claim maintenance does not hold true. If the alimony is being paid on a monthly basis, the Supreme Court of India has set 25% of the husband's net monthly salary as the benchmark amount that should be granted to the wife. There is no such benchmark for one-time settlement, but usually, the amount ranges between 1/5th to 1/3rd of the husband's net worth.
The court will be deciding the final alimony amount. In your case as your working and earning more than your partner. there will not be alimony amount.
you don't have any rights to ask maintenance because you are. working women. you can take divorce easily
