Greetings! You may file the divorce petition under the Hindu Marriage Act along with Petition under Protection of women from domestic violence Act. You may take consultation for further legal advice and assistance. Regards.
Dear client I am sorry to hear about you situation how ever you can opt for mutual consent divorce only if your husband is also ready for the same if he is not ready to go add and file for the boss as for the mutual consent then you have to see divorce under section 13 of the Hindu Marriage Act on the different circumstances and you can also file for abuse and domestic violence
1. You can File Mutual Divorce case in court through lawyer. 2. For filing Mutual Divorce case both husband and wife has to stay seperate for one year. 3. The document such as passport size photo, marriage invitation card, marriage photos, marriage certificate will be required. 4. The procedure for mutual divorce is six months but you can obtain it within 8 days also.
If the behaviour of your husband is intolerable towards you then you can always serve him a legal notice regarding your thoughts of not living with him anymore. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in maximum of six months. For more legal assistance I am just a call away.
First you hire a lawyer and file a suit against your husband.
