Before Filling any Court Case against Husband, your sister can file a complaint to the Police Station u/s 498(A) Domestic violence against her Husband but they (Police) didn't entertain you directly because in Wife and Husband case matter Police will send you first for counselling to women's cell and after that's report copy of counciling then only Police can register your complaint in D.V. cases but you must remember before going to Police Station or Counseling , if you take proper guidance from Best Advocate then you should get good results because whole case is depends upon prime facia means F.I.R. Hi, Your Sister can file for divorce from her husband and can also complaint to police for domestic violence and cruelty. Your sister is entitled to custody of her child and child maintenance would be paid by your husband. While court proceeding in the court your sister can ask for interim maintenance from your brother in law. The court generally allows maximum 25% of husband income's as alimony which could be lump sum or monthly and this is excluding child maintenance that your brother has to bear. Filing a complainant against her husband in the near by police station with help of you and your family should first step taken by your sister and then Divorce petition should filed in the court with help of a lawyer.
