You are Suppose to file Maintenace Case and you have file the divorce Case on basis on mental and physical torture. Have to mention what type of torture u had faced.
Hi, You can claim maintenance from your spouse, they have a legal right to support you when they are earning more than you. You can ask for a one time or monthly alimony. Under S.125 of the Criminal Procedure Code, you can also claim interim maintenance to support yourself over the course of the divorce proceedings. Suppose you have filed a petition for decree of divorce while filing the same or during its pendency, such a relief of maintenance can be claimed. The SC of India, in this regards, has ruled that an estranged woman can claim maintenance from her husband in spite of her efforts to earn a monthly income if that is not enough for her maintenance.
