I had married in the year 2014 and after 3 years of marriage, my wife gave birth to a girl child in 2018 due to her physical illness. Now she took the baby and went to her parental home filing false 498A and Dowry Cases against me and my mother and father. I have every proof that we have not harassed her in any situation. Now I want to fight against this case and also I want to take a divorce from her along with the baby girl child custody to me. How can I proceed further?

Hi, The first thing to do is to file for anticipatory bail for you and your parents. All the evidence you have can be presented to the Court during the divorce proceedings, when seeking custody of your daughter.

file your reply and take necessary steps in cases filed by your wife and you can file a suit under gardian and ward act for custody of said child and you can also at same time file a divorce petition on ground of false alligations.
