    The marriage can be nullified as being voidable if the consent of either party or his guardian, as the case may be, was obtained from force or fraud. The husband can file a case against the woman on Section 420 of IPC, ie, for cheating in court and then apply for divorce too. Hence, the woman should have told before about her sexuality before the marriage.

    If you are sure then you go for FIR instead of divorce. Then your son can get divorce (annulment) for cheating and fraud and no consummation of marriage.
