    Dear Sir, If it is not from Family Court then such divorce is not valid. Anyway if same couple marrying again does not attract any Section of Indian Penal Code. Please give me rank after viewing my details. Please call me for further assistance.

    Divorce obtained abroad by mutual consent is valid in India But the divorce Certificate will not be accepted for court marriage. You have to get your abroad divorce validated in India under section 7 of family court act . After getting validated, you can do whatever you want to do for remarriage without any legal complications.

    Hello If a Non-Resident Indian (NRI) married in India wants a mutual consent divorce, then he/she can do so by filing a petition in India or in the country where both of them are residing. The Indian law provides for this exception of filing a divorce in another country. It says that a petition can be filed within the jurisdiction of the courts of which the parties to the marriage last resided. Will this Foreign Decree be Recognized by the Indian Courts? The Indian courts do not recognize the decree passed by the foreign courts if the decree so made is inconclusive under Section 13 of the Civil Procedure Code, 1908. Thanks

    Hi, Indian will accept the divorce from other countries if they consider Indian laws for granting divorce. Since there is an involvement of two different legal systems, private international laws will be applicable and if it is not contrary to Indian laws for the time being in force, it is valid.
