Dear Client, The mutual consent divorce can be filed under Section 28 of The Special Marriage Act, 1954. When both the husband and wife are living seperately for a period of one year or more, a petition for divorce can be filed at the district court.
If there is a religious gap between the couples then the marriage must have taken place according to the special marriage act and accordingly the divorce will also be according to the said act.
