Dear client 1 year of separation period is mandatory for a divorce however if you want to get done with it then you can go head and file a petition seeking that you and your husband are leaving separately for more than one year and in that situation the court can reduce the separation period

Yes, For filing Mutual Divorce case both husband and wife has to stay seperate for one year but you both can show in mutual divorce petition that you both are living separately for one year simple.
Yes the minimum time period prescribed by law is one year and no divorce petition can be entertained if it's filed before one year. But living separately doesn't mean that you need to be just apart from your partner. You both can stay together under the same roof and go for mutual divorce. But if the behaviour of your partner is intolerable then it's better to opt for judicial separation right now and after six months you can file the mutual divorce petition before the family court.
