Dear Sir, If such person is not arrayed as a party then Court has no business to record testimony of such person. It is a criminal Court and normally the judges refrain from using such powers. Please give me rank after viewing my details. Please call me for further assistance.
Hi, It is the duty of complaintant to bring the person against whom he alleged Adultry. Court will issue Sommons. But if a person is involved in Adultry, it is up to that person to decide whether he wants to collaborate as witness or not. And Adultry is not a Crime any more. But it is good ground for Divorce.
Hi, The person alleging adultery must prove that their spouse committed an adulterous act via direct evidence (e.g., eyewitness accounts; admissions by the guilty spouse and/or the paramour) or, more often, via circumstantial evidence. If you find it helpful, kindly rate my answer. Thank You.
