    The wife can move back to her father’s house anytime if ex-husband’s place is not a safe place to live. They are not considered as husband and wife as they did not legally get married after the divorce.They are considered merely as couples living in a live-in relationship. Ex-mother-in-law will be liable for her acts and cruelty, attempts to assault and threats to life of the wife. If the mother-in-law had behaved the same way when they were married, then filed a domestic violence case on them. the husband is allowed to file a case for the mutual custody of the child and shall act as the court advices them to. The wife here, is also entitled to claim compensation from the husband for herself and for her child from her ex-husband under the section 125 of the Code of Criminal Procedure, 1973.

    As of date you are not married so there is no mother in law. Your current relationship is live-in. So it is not case of Domestic violence. You can ask for maintenance for you and baby. Attempt to assault is also criminal offence. However the assault was attempted with any weapon or item or only hands ? You can certainly leave and go to your parents house. The Child custody depends on the Divorce judgement.

    Hi, Since, you are legally divorced, and you did not remarry, you will be considered as a couple living in a live - in - relationship, not as a husband wife. You will be entitled to claim maintenance for your baby and for yourself. If you like my answer, please rate me.
