Dear Sir, You may get file maintenance case and get attach the properties of your brother-in-law and thus your sister may get regular maintenance for herself and her children. There is no limitation to file maintenance against the husband. You may also file Domestic Violence case against him and his family members.
Your sister first file a complaint against her husband to the nearest police station of cruelty Also seek maintenance from her husband

Divorce is of two types. One is mutual and the other one is contested. And if the behaviour of your sister's husband is intolerable towards her then she can always file for a contested divorce under cruelty grounds. You can also file a complaint against her husband under DV act and claim her monthly maintenance or the lumpsum alimony.
